Agreement

By using this site, buying a product, joining the Discord or booking a mentorship session, you agree to these terms, to the Privacy policy, and to the Risk disclosure. The Risk disclosure is incorporated into these terms in full. If you do not agree with any part of them, do not use the service.

These terms are between you and ("TrendDelta", "we", "us").

You must be at least 18 years old, and old enough to enter a binding contract where you live, to buy anything from us.

What we provide

TrendDelta sells educational and analytical products:

• Invite-only TradingView indicators, sold together as the TrendDelta Indicator Suite and billed monthly or yearly on a recurring basis.
• A paid premium room, hosted on Discord and billed monthly or yearly on a recurring basis.
• One-to-one mentorship sessions, sold per session.

TrendDelta is an educational and analytical service. It is not investment advice, not a recommendation to buy or sell any security, future, currency or other instrument, and not a solicitation to enter any transaction.

We do not manage accounts, execute trades, handle client funds, or provide personalised recommendations. Mentorship is instruction, not advice, and a mentor will not tell you what to trade.

Licence and access

On purchase you receive a personal, non-exclusive, non-transferable, revocable licence to use the indicator for your own trading. Access is granted to your TradingView username and is tied to it.

You may not:

• Share, resell, sublicense, rent, lend or transfer your access, or give anyone else the use of your TradingView account for the purpose of accessing our scripts.
• Copy, decompile, reverse engineer, or attempt to derive the source of any indicator.
• Publish, redistribute or republish our code, logic, or materials, in whole or in part.
• Use our materials to build, train or market a competing product.
• Represent our output as your own work, or as advice you are qualified to give.

We may suspend or terminate access, without refund, if you breach this section. All intellectual property in the indicators, the site, and our written and video materials remains ours.

Payment, renewals and refunds

Payments are processed by Whop, which acts as merchant of record. Your purchase is also subject to Whop’s terms, and card details are handled by Whop and its processors, never by us.

The first charge is taken at checkout, at the price and interval shown there. Recurring subscriptions then renew automatically at the same interval until you cancel. You can cancel at any time through Whop; cancellation stops the next renewal and does not refund the period already paid for.

Refunds: all sales are final. Indicator access and Premium Room access are delivered immediately and cannot be returned once granted, so we do not offer refunds on either. Where a statutory right of withdrawal applies to you, that right is unaffected by anything in this section.

Community conduct

The Discord and premium room are shared spaces. We may remove content or remove you, at our discretion and without refund, for harassment, hate speech, spam, scams, solicitation, sharing paid material with non-members, impersonation, or giving other members personalised financial advice.

Anything posted by another member is that member’s own opinion. We do not endorse it, verify it, or take responsibility for it. Do not act on another member’s post as though it were advice.

Availability

We provide the service as it is and as it is available. We do not warrant uninterrupted or error-free operation. Our products depend on TradingView, Discord and Whop, and we are not responsible for their outages, changes, pricing, or decisions about your account on their platforms.

We may modify, suspend or discontinue any part of the service. Where we discontinue a paid product you have an active subscription to, we will not bill you for periods after it stops.

Disclaimer of warranties

To the fullest extent permitted by law, the service is provided "as is" and "as available", without warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that any indicator, alert, level or piece of analysis is accurate, complete, timely or profitable.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any trading loss, lost profit, lost opportunity, lost data, or any indirect, incidental, special, consequential or punitive damages arising from your use of the service, whether or not we were advised such loss was possible.

Our total aggregate liability to you for any claim arising out of or relating to the service is limited to the amount you actually paid us in the twelve months before the event giving rise to the claim.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

Indemnity

You agree to indemnify and hold us harmless against any claim, loss, liability or expense, including reasonable legal fees, arising from your use of the service, your trading decisions, your breach of these terms, or your violation of any law or third-party right.

Changes to these terms

We may update these terms. The version published on this page is the version in force, and the date it took effect is shown at the top. Continuing to use the service after a change means you accept the updated terms. For a material change affecting an active subscription, we will give notice through the Discord or by email before it takes effect.

Governing law and disputes

These terms are governed by the laws of Canada, without regard to conflict-of-law rules. The courts of that jurisdiction have exclusive jurisdiction over any dispute, except where mandatory consumer law gives you the right to bring proceedings where you live.

General

If any provision of these terms is held unenforceable, the rest remains in force and the unenforceable provision is applied to the maximum extent permitted. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy policy and the Risk disclosure, are the entire agreement between us.
